We represent
you, the buyer, to the extent of ensuring that you acquire good and marketable
title to the property. We can also advise you regarding legal questions
concerning title to your property, title insurance, and the covenants and
conditions of your loan documents. We represent the mortgage lender to the
extent of assuring full compliance with its loan closing instructions.
We are responsible for conducting the title examination of the property;
ensuring the deed of conveyance and loan closing documents have been properly
prepared and executed; receiving and disbursing the closing funds properly and
pursuant to the HUD-1 Settlement Statement; reviewing the survey prior to the
closing; properly closing the transaction and recording the deed and deed of
trust; and ensuring the owner’s and lender’s policies of title insurance are
issued in proper form.
